Terms & Conditions
Welcome to De Dive Centre Sdn. Bhd. By booking a dive package, dive course, or trip with us, you agree to the following Terms and Conditions without variation. The terms and conditions set out here in which De Dive Centre Sdn. Bhd. may vary from time to time at its sole discretion with/without notice to you and you acknowledge that the usage of this website constitutes your agreement to all the terms and conditions in force De Dive Centre Sdn. Bhd. for the time being as set out herein. Please read them carefully.
Booking & Payment
1. Booking & Payment
- All payments are non-refundable.
- Deposit: 50% deposit is required to secure and confirm your booking.
- Balance Payment: The remaining balance must be settled in full at least 21 days prior to your scheduled travel date.
- Last Minute Bookings: Bookings made within 21 days of travel require full payment immediately upon confirmation.
2. Medical & Age Requirements
- General Health: All divers must be in good physical health before your trip. For divers taking up courses with us, you will be required to complete a medical questionnaire prior to diving.
- If you are 45 years old or above, you are required to provide a doctor’s approval (medical clearance) confirming you are fit to dive.
- This medical clearance must be dated at least 2-3 days before the course starts to ensure the clearance is recent.
- You must bring the physical copy to Tioman and pass to us.
- Failure to provide this may result in you being unable to dive, with no refund provided.
3. Diving Courses (OW/AOW Students)
- Certification Collection: Upon successful completion of your course, please remember to collect your underwater certification from our counter crew before leaving Tioman.
- Incomplete Courses: If you are unable to complete your course during the scheduled trip:
- There is no refund for the package.
- Retake Option: You may return within one (1) year to complete your training.
- Retake Costs: For the rescheduled trip, you are responsible for paying the instructor fee, accommodation, and personal expenses.
- Please consult our customer service regarding the retake schedule, duration, and specific fees before departing.
4. Fun Divers & Missed Dives
- No Refunds for Missed Dives: If you miss a scheduled shore or boat dive, or fail to complete planned dives due to personal reasons (e.g., seasickness, fatigue, change of mind), no refunds will be issued.
5. Liability & Risk
- Scuba diving involves inherent risks. All divers must sign a Liability Release and Assumption of Risk Agreement before diving.
- De Dive Centre Sdn. Bhd. is not liable for any loss, damage, or injury sustained during your trip, except where such liability is imposed by law.
6. Environmental Policy & Marine Protection
We are guests in the ocean. To preserve the underwater environment of Tioman, all divers and snorkelers must adhere to the following:
- Code of Conduct: We strictly enforce the “No Touch, No Chase, No Feed” policy. Please leave only bubbles behind and take only memories (or photos).
- Fragile Environment: All marine life, particularly coral, is extremely fragile. Please maintain good buoyancy and awareness to avoid accidental contact or damage.
- No Glove Policy: We adhere to a strict no-glove policy. This discourages touching and protects marine life from bacteria transfer and physical damage.
- Zero Tolerance on Destruction:
- Divers or snorkelers observed harassing marine life, collecting souvenirs (dead or alive), or exhibiting environmentally unsafe habits will be given a warning.
- In severe cases or repeated offenses, De Dive Centre Sdn. Bhd. reserves the right to prevent the individual from conducting further dives or snorkeling activities.
- Note: No refunds will be issued if diving is suspended due to environmental violations.
7. Management Discretion & Safety
Safety is our highest priority. De Dive Centre Sdn Bhd. reserves the final right to determine who may participate in diving activities.
- Diver Competency: We reserve the right to refuse service based on a diver’s experience level, date of last dive, or observed comfort level in the water. A Refresher Course (Scuba Review) may be mandated before joining boat dives (recommended if not diving for more than 6 months)
- Fit-to-Dive (Sobriety Policy):
- We operate a strict policy regarding alcohol and drugs.
- We reserve the right to stop a person from diving if they appear physically incapacitated due to illness, injury, intoxication, or severe hangovers.
- Do not drink and dive.
- Unsafe Behavior: If a diver risks their own health or the safety of others through aggressive behavior, failure to follow guide instructions, or negligence, we reserve the right to terminate their diving activities immediately.
- No Refund Policy: In the event that a diver is prohibited from diving due to intoxication, unsafe behavior, or lack of competency, no refunds will be issued for the missed dives.
